Question Chris Smitherman and He Will Play the Race Card

When I read this week's Enquirer Politics Extra column: Smitherman: Using race card on Cranley 'appalling' I smiled.  I found it funny.  No, racism isn't funny.  Chris Smitherman, Cincinnati City Council Member, however was doing something that I found worthy of a grin, he was contradicting himself.

That's not a surprise, I know, but still worth a quick grin.  He's attacking black people for doing what he thinks is playing the "race card" against Smitherman's ally, Mayor John Cranley a Conservative Democrat.  Cranley has his own issues, but on this point, Smitherman is the one walking off the ledge with his gross hypocrisy. Here's the relevant part of the column:

Racism is real," said Smitherman, former head of the local NAACP. "It's not something that anyone should be taking lightly. It's appalling that they would so loosely try to define (Mayor) John Cranley (and Enquirer reporters) as racist. Unacceptable. It diminishes a long history of civil rights work and the fight against institutional racism that continues today."

His contradiction is quite simple: Smitherman has played the race card.  How do I know?  Simple, he used it against me on Twitter for daring to call him out for being a Republican. His implication was that I was questioning him because he is black. So, yes, total bullshit from a bullshiter. Here are some examples from last year:

Where did his this come from you might ask? It came directly from my efforts to question Smitherman on his political affiliation. It is my contention and the overwhelming evidence supports it that he is a Republican.  He publicly will not say he is a Republican and his twitter responses above are part of his reaction to my questioning him because of his public endorsement of Republicans.  That however was just the latest.

Smitherman's Republican affiliation has a bizarre origin.  It started publicly with Smitherman, as president of the local chapter of the NAACP, joining forces with local right-wing extremist group COAST and their lawyer and sometimes leader Chris Finney.  Finney has is a long time anti-city activist who also was the author of the anti-LGBTQ article XII amendment that was passed (later repealed) making it legal in Cincinnati to discriminate on the basis of sexual orientation.  This is odd because Smitherman has generally voted for LGBT rights issues, but none-the-less he joined forces with a known bigot. Smitherman and COAST joined forces to attack the City and efforts to improve the city, specifically Downtown and OTR.

Fast forward to the 2016 primaries. Chris Smitherman had in the past voted in the Democratic primaries for president.  In 2016 he switched parties.  He voted in the Republican primary.  This is publicly available information and is the closest in Ohio to being considered a "registered" Republican. Later on last year he started endorsing candidates for office and the only ones I could find were republicans:

Additionally, Smitherman endorsed also-ran Republican Hamilton County commission candidate Andrew Pappas over long time fairly moderate Democrat Todd Portune. You noticed that there were not any Democrats above.  He didn't voice support for single Democrat running for County wide office, at least not publicly that I could find.

To top it off, Smitherman tweeted several things that show his allegiances. On election day last November where did he go? Surprisingly he went to Republican strong-hold Sayler Park:

Sayler Park was one of the very few parts of Cincinnati to vote in favor of Donald Trump for President. He didn't tweet from any other neighborhoods on election day, so if he went to any, they didn't make the cut for publicity.

I point this out because I have questioned Dusty's political affiliation more than I have questioned Smitherman's. This is important because Smitherman's basis for his response to my questions on his political affiliation is based on his fabricated belief that it was because of his race. That's the race card I was talking about before. It is the game he is playing to mislead the public.

His re-election strategy relies on votes from black voters in Cincinnati. Being a Republican is not a positive to a large portion of voters in Cincinnati, particularly black voters. He also needs to get the support of Republican voters as well, if he has a chance to get back on council. He only got on council by around 2,500 votes and has not made any new friends that he already didn't have. Thus knowing his party affiliation and allegiances is a valid consideration for a voter. 

Another consideration is honesty.  He's not being honest when he pretends to be independent. Independents don't pick one party to the exclusion of the other(s.)  Smitherman's desire to mislead people shows that his real motivation is for himself. He wants to run for County Commissioner and the only way he can is by being a Republican. He's put himself in such a corner that he will never be able to win. The only type of coalition that would be similar to conservative blacks and far right-wing COAST Republicans would be Trump supporters and that is not a winning team in Hamilton County. He appears willing to create illogical alliances, but even he stayed away from directly endorsing Trump.

As long as Smitherman continues lying about not being a Republican, I will continue to call him out on his dishonesty and hiding his true motivations and allegiances.  He can try to fool people, but that doesn't mean the people will be fooled.

The Smitherman Gambit - Don't Bet on it Winning in November

Christopher Smitherman has a plan to win a seat on the Hamilton County Commission.   The former member of Cincinnati City Council has gambled that a perfect storm will occur that if he takes the right steps could lead him into a win. His wager is one that requires many moving parts to align perfectly. Call this the Smitherman Gambit, his path to "victory", at least if all of it happened, without a hitch.  Here's my interpretation of the list of steps needed for the Smitherman Gambit to work.

1. Obfuscate: Smitherman's first step is to pretend to be many things to many people. 
2. Subtlety and not so subtlety align with Conservatives and Republicans: This includes voting in the Republican Party Primary, gaining the support of right wing extremists like COAST and publicly supporting Republicans just short of Trump. This is easy for a Conservative like Smitherman to do and why he is a Republican in all but name only.
3. Attack the Democratic Party and anyone not directly aligned with John Canley: This was highlighted by Smitherman's participation the promotion of the text messaging scandal manufactured by Republican lawyers and the cooperation from a sympatric Republican judge.
4. Give up on being the Mayor of Cincinnati: This one hurt.  The ego of Smitherman so desired the title of Mayor. His overuse of the unearned title of "Vice Mayor" is case in point.
5. Rebuff invitations to declare himself a Republican: Being labeled a Republican will hurt his standing amongst a segment of African-American voters that don't know he's aligned with the extreme Conservative Republicans.
6. Bank on a Republican Wave Election in  2022: The politics 101 conventional wisdom states that the1st term midterm election will be a significant win for the party out of power.
7. Target a Democratic Woman Opponent: Stephanie Dumas fits a type the typical Conservative Republican campaign would target.  The logic presumes Republicans would pick a man over a woman 9/10 times. There is truth to that logic, as Republicans seek to have power over women’s bodies. What also would appeal to Smitherman is trying to gain the support of Conservative black male voters. He may gain that support, but Smitherman may have over estimated how many Conservative black men there are in Hamilton County.
8. Attempt to finesse the Hamilton County Republican Party into not fielding a candidate for County Commissioner: Smitherman needs to face any Democrat one on one.  This is a must have to ride any Republican wave.
9. Beg and plead for Republican Support: Even without a Republican running against him, Smitherman would run like a Republican and would depend on the campaign contributions from big GOP donors.

So, now that we are just about a month away from the election, how well are things going for the Smitherman Gambit? 

The clear answer is not so good.  

He has done pretty well on steps 1 through 5. Alas, those were the easy ones.  They didn't require him getting help from anyone else outside his own supporters.  

Steps 6 and 7 are not working out so well.  The Republican wave is not going to happen in Hamilton County.  The SCOTUS abortion decision has vastly reduced any GOP wave.  That wave would have needed to be strong in Hamilton County for Smitherman to do well in a one on one race against a Democratic candidate.  A black woman candidate is the type of candidate that many Republicans want to run against, but that pushes a niche tactic that just turns off voters from a campaign that even hints at pushing those buttons.

The pipe dream in the Smitherman Gambit was from the beginning focused on step 8.  He couldn't stop anyone from running in the Republican Primary.  That by itself is what makes his chance of winning VERY low.  He has to convince Republican voters to vote for him over a candidate with the word "Republican" next to his name. Matthew O'Neill is the Republican candidate and got a formal Hamilton County Republican Party endorsement.  If O'Neill get's 5% of the vote, that alone would likely be enough to doom Smitherman’s campaign.  Depending on how well Democratic turn out occurs, it may not even matter, as Dumas could win an full 50%+ 1 majority.  It is going to take a massive campaign to convince the average Republican voter to go against their party and for Smitherman.  I could imagine O'Neill getting 20% or more of the vote based on party ID alone, even without the Republican donor money Smitherman is getting.

Smitherman’s chance relied on the full support of the Republican Party and he would have to cross over and get some of the past voters going to the Dems. That along with a less than stellar Democratic turnout, where elements of the perfect storm that has failed to materialize for Smitherman. His miscalculation has been epic. The rest of his campaign will be one for him to demonstrate if he has any sense of grace or if he will go down in a fire pit of dirty politics, clawing at his opponents in vain. His reputation is not as a graceful person, so I fear the display of pettiness and animosity he and his campaign team displays towards the rest of the county will be grotesque. I hope I am wrong about that, but hope is wasted on Conservatives too scared to publicly declare they are a Republican.

Cranley and Smitherman Both Want a Blue Pony, with Jason Williams as Stable Boy

With the John Cranley's self made drama at City Hall this month, one might be fooled into thinking that the City Manager is a threat.  Harry Black is a not a threat, he is a roadblock.  He is blocking the lustfully power hungry Mayor and 'Vice-Mayor', John Cranley and Chris Smitherman respectively, from illegally seizing control of Cincinnati City government.  Other than the City Manager and City Council, the real hurdle getting in their way, and making their efforts illegal, is the the law, specifically the City Charter and how it defines the role and power of Mayor.

Both Cranley and Smitherman want power.  They want to be a strong mayor.  I really hope this isn't some type of fetish role-playing for either man, trying to be a modern day Boss Cox.  I get they might like gilded age costumes, but that's just taking it too far.  Steampunk Smitherman does sound like a good nickname, however.

The problem for them is that the Mayor has limited power.  The mayor is not the boss of the city.  The mayor has  some power, but not total control of all City employees.  Cranley wishes he had that, but knows unless he can somehow remove term limits (unlikely as the GOP likes them), he's only working for his legacy.  Cranley's legacy rests solely on Republican Chris Smitherman.  Yes, I called him a Republican.  I am probably going to be called a racist for daring to call a duck a duck, but Smitherman's Twitter StormTroopers can bloviate all they want.  I just hope they can figure out I am a real person.  They've claimed I'm an pen name for elected officials or maybe they think I'm a Russian Bot, but here's hoping the kids can study up.  Maybe even read the over 15 years worth of blog posts I've written, on my archive.  I may not be a good writer, but I sure as Hell have been doing this long enough to know who the players are in Cincinnati politics.  I've been around long enough to know that when you vote in the Republican primary, endorse Republican candidates, adopt Republican polices, campaign with Republicans, attack Republican enemies, and take Republican money, then I am going to call you a Republican.  If Smitherman thinks he can't get elected mayor as a Republican, he should understand that lying about you policies and allegiances isn't going to work either.  You can't compartmentalize like Yasir Arafat in Cincinnati.  Don't mix messages with different audiences.

The funny twist in recent Enquirer coverage of the Mayor's Chaos comes from the resident hack political columnist Jason Williams. He is almost criticizing John Cranley.  I say almost, as Williams still tried his best to blame Cranley's drama on what he's calling the 'urban progressives' and 'Progressive 5.'  Not sure what he means by urban, as this is a city, but we do have a suburban mayor, so I'll presume Williams isn't a fan of people who like cities. He's certainly championing those against the City of Cincinnati. That would include Republican member of council Chris Smitherman.  Williams, I guess, finally figured out he's not going to get a job in Cranley's administration, so now he's pushing the anti-city Manager form of government that Smitherman painfully desires.  His lust for power borders on the psychotic and makes Cranley's penchant for sticking it to his political foes look like pin pricks in comparison.  A character like Smitherman without a professional city manager to run the day operation would look like a small version of a Trump White House.  Same kind of ego, but with more outward signs of psychosis.

Strong mayors are not a good idea in Cincinnati and not with those wanting it now.  Former Ohio State Senator Eric Kearney stated well what I believe is the underlying problem with the position Cranley and Smitherman (with Williams) are putting forth:

If something goes “wrong” in the federal government we do not blame the U.S. Constitution and its Amendments (and seek to change them). As well, we should not blame (and seek to change) the City Charter.

The problem is with the way they are trying to govern.  They want the government and the populace to bend to their will.  That's not leadership, that is bullying.  Leaders don't create controversy as a means to push forward as a political pretext to change the form of government. If there is a problem with the form of government, make the claim as to why, present facts, and be honest.  If you just want to gain more power, then I say fuck off, we don't need mini-Trumps in Cincinnati.

Chris Smitherman Arrested

The Enquirer is reporting that Cincinnati NAACP Chapter President Chris Smitherman was arrested this morning outside a school construction site. I am sure we shall be besieged with how it matters to justice that Mr. Smitherman can't seem to get the CPS to hire the people Smitherman wants them to hire, but I am really am starting not to care.

If you are going to protest something, then you need to define what your goals are, something the local NAACP President has failed to do. Just saying you want more African-Americans hired is about as focused as Pastor Phil telling us we should all be nicer to your fellow man. Pastor isn't standing in front of schools yelling at people that we must be nicer. Tell us the goal. Make that goal reasonable. Work with African-American Chamber of Commerce to find viable businesses to provide good service to our Schools.

Published reports indicate that Smitherman has provided the CPS with little more than names and phone numbers of people he thinks should be hired. Smitherman needs to provide the detail and at least basic support documenting that the people have relevant companies that can provide valuable services. Our school system does not exist to provide employment to Smitherman's friends.

If there are problems in how contracts are handed out at CPS, Smitherman and his minions need to stop playing games. The attention is not going to gain you anything. He is turning off his possible allies. He is a mockery and is sullying the work the NAACP has down locally and across the country. He needs to find a strategy based on sanity, not on Smitherman's desire for fame and fortune. This I fear is just another in what will be a long line of stunts that Smitherman will waste time and effort on, instead of actually finding solutions for problems.

Smitherman Misleads Public About Conflict of Interest on Streetcar

Chris Smitherman has an ethics issue and is not being honest about it. The Cincinnati Business Courier has reported that Smitherman's brother owns a company that has a contract to build part of the Streetcar project. Smitherman is claiming, without proof, that he's only known about this for a week and that his brother no longer has a contract.  That connection is an ethics issue that Ohio Ethics Commission should investigate.

Smitherman provided no proof the contract has been nullified or rescinded. That's part one of the deception.

Part two is that Smitherman was not being truthful when he stated he knew nothing of his brother's contract prior to a week ago. Well, that is not true, and this 2009 NAACP press release provides evidence that he did know his brother was working on the Streetcar project.

The Cincinnati NAACP has been briefed that Jostin Concrete has joined the Mayor's streetcar team. The owner of Jostin Concrete is the brother of Cincinnati NAACP President, Christopher Smitherman. Citizens will have the opportunity to witness the integrity and commitment of President Smitherman, the Cincinnati NAACP leadership and membership. Jostin Concrete may have a great opportunity, however, building a "choo-choo" train is the wrong public policy direction for the masses of Cincinnatians. Smitherman says, "I deeply respect the independence of my brother's company. I am confident that the issue will be rejected in November."

So, this is the new chairman of the Law and Public Safety Committee lying to citizens of Cincinnati? If he is making false statements about this, how can anyone trust anything he is saying? He should not vote on the Streetcar until he obtains a favorable opinion from the Ohio Ethics Commission and Smitherman must provide proof of all of his claims.

We don't need liars on City Council.

Smitherman's First Act of Grandstanding

It didn't take long, not even a week, and already Chris Smitherman has committed his first offense of Grandstanding in his term as a Cincinnati City Council member.

Smitherman is all in a tizzy because a majority of Council has approved a council rule removing a 90 day requirement for putting ordinances on the Council calendar.  Smitherman is upset because a majority of the council voted.  This would be a majority of the elected representatives of the people of Cincinnati.  They voted to establish their own rules, as provided by the City Charter which operates legally under State law.  Smitherman is "threatening" to sue.

According to the article, I think I can take the quote off the word threatening because it states that unless council votes his way, he will sue.  That sounds like a form of extortion, but in political activities you can get away with more than the average person.

I do question Smitherman, as a member of Council, taking legal action with any indication or standing as a member of the City Government without use of the City's legal representative.  If he, as he threatens, gets his right wing zealot attorney, and anti-gay bigot, Chris Finney to sue the city, I'd like to know what standing Smitherman is planning on using.  Also, who would pay Finney's fees?  If any legal fees ever go to any non-city lawyer suing on behalf of  Smitherman on a city issue, the fees should come from Smitherman's budget.

Section 5a of Article II of the City Charter states "The Council shall organize itself and conduct its business as it deems appropriate...."  That's what they did with a 5-3 vote (one member was absent.)

Section 2 of Article III of the City Charter state "The Mayor shall preside over all meetings of the council, but shall not have a vote on the council."

What is he going to sue over? The City Charter was followed. This is Democracy in action.

Smitherman better get used to not getting his way on council unless he can get 5 or for veto-overrides, 6 votes on an issue.  He can't act like a child and threaten to sue over everything, especially when he has no grounds for a law-suit.  He can complain about the rule, but using threats to change the minds of his fellow members of council isn't going to win many (no one) over.

A Public Demonstration that Smitherman is Crazy

Yes, most people know that Chris Smitherman has a screw loose. If you don't know, then have a look at this over 13 minute long rambling video that Smitherman made himself. He has no support to back up any of the wild and outlandish claims he makes, but damn it sure makes a good (yet boring) Crazy Guy video.

Smitherman is a big supporter of John Cranley and it has been reported that Cranley has stated that Smitherman would be a "big part" of the Cranley administration if he won the Mayor's race.

Oh, by the way, Smitherman is a sitting member of council and is running again. He makes these types of videos often. Who supports him? What type of person believes the crap he is saying? Ignorance is not much of an excuse, but I guess that's the type of voter Smitherman preys upon.

Side note: John Cranley had a link to this video on his Facebook page today. It is no longer there. I guess Cranley's knee-jerk judgement is to believe and trust what Smitherman says on the surface, but when people pointed out the lies Smitherman was saying about Democrats running for Council, someone in the Cranley camp took it down. More bad Cranley Judgement, just like John Elkington.

Delusions of Grandeur Continue to Flow From Smitherman Like a River

Today's article from the Enquirer's Jane Prendergast on Cincinnati Council Member Chris Smitherman was an interest read. I say that because my blog (and myself) were quoted and I represented the face of Criticism of Smitherman. I take that as a compliment. I try to give voice to issues and topics that don't get lots of press. Criticism of Chris Smitherman does not get much media attention. I am glad it got some today.

The other more entertaining portion of the article comes from a direct quote from Smitherman himself:

“I will become the mayor one day,” he says, though he won’t run in 2013 when Mallory leaves.

I don't know what planet Smitherman is living on, but it appears to be akin more of an alternative-reality than anything resembling the actual Earth, where the rest of us reside. Smitherman at best has a niche voter base that he segments more each time he opens his mouth in public. Unless he plans a cultural revolution to drive out everyone in the City who disagrees with him, then I don't see him winning an election for Mayor against nearly any other remotely credible candidate.

Those of us in the political opinion world would love to see him run someday, just to watch him lose in the primary. How a man who wants nothing more than the destruction of the urban core could think he could be mayor is beyond my comprehension. I guess that's why I can't see it as anything other than a delusion of grandeur. One thing I don't doubt about Smitherman: he has a high opinion of himself. That doesn't translate to anything unless you can make stuff happen. The only stuff he can make happen is gettting in the newspaper by making outlandish comments. Negative press attention in the end might earn you a day old bag of doughnuts, but little else.

What The FOP Forgot About Chris Smitherman

While I am still unable to find an official listing of Cincinnati FOP endorsements (CityBeat has a list posted yesterday), I must point out what I would think was a clerical error.  Chris Smitherman is listing the FOP as one of his endorsements for Cincinnati City Council.  This is what I would expected if we lived in Bizarro World, where pigs actually fly.  Instead I will collectively pinch everyone and confirm that you are dreaming.

That in mind, I will just have to assume that someone in the FOP must have broken in the evidence locker and took out a truck full of weed and drove it over to FOP headquarters before they picked their endorsements.  What I am sure the FOP didn't bother to do was vet Chris Smitherman before his endorsement, other than to determine if he would pledge not to fire anyone on the the police force and for his No vote on State Issue 2 (SB5).

If they did, they might have dug up this article from Greg Korte in the Enquirer about some of the antics Smitherman pulled right after taking office as a Council member in 2003.  As soon as Smitherman had run a 'moderated' campaign as a Charter Committee endorsed candidate, he came right out of the shoot attacking the Cincinnati Police Department.  He demanded a list of where all police officers went to high school.  He was so loved by the FOP back then former FOP President Keith Fangman had this to say:

"Chris Smitherman is the master of illusion," said Keith Fangman, the Fraternal Order of Police vice president. "He hoodwinked the voters into believing he wanted to improve police-community relations. And he has done the exact opposite."

So, I guess the FOP has now been 'hoodwinked' into giving an endorsement.  If Smitherman is elected, I would make a bet at what parts of the CPD he would start targeting.

No matter how much of a Republican Smitherman claims to be, which he should do as he's getting praised by the likes of Chris Monzel, not to mention COAST and Charlie Winburn.  I really don't understand how the local NAACP can just abandon it's principles under the ruse of getting one man more power.  Making deals with the 'devil' will do nothing but ruin you in the end.

Lie of the Week

The Winner goes to Councilman Chris Smitherman for this quote from Greg Korte's column:

"I don't need a history lesson on civil rights, or my ancestry, or how African-American people in this community have fought for their rights," he said. "I am not grandstanding."

When you defend a group of racists and do nothing to counter their hate speech in what I would say is a political move to appease the "militant vote," then yes you are grandstanding Mr. Smitherman.

I also think Greg Korte forgot some quotation marks in this sentence, "Now, a new generation of civil rights fighters - people like Nate Livingston, William Kirkland, Kabaka Oba and Terry Summers - have been using the City Council podium as their soapbox." Either that, or the sarcasm just did not come across. How can you call these guys "civil rights fighters" with a straight face? If Greg did not forget the quotation marks, then I think he needs to reassess the beliefs of the boycott B gang, as should the rest of the media, especially the local AP writers.

Smitherman proving to be disappointment


Councilman Christopher Smitherman would apply zero tolerance to Cincinnati police officers who use racial slurs and would start with the termination of an officer who might have used a slur five years ago. Yet, when a vocal, shameless minority of the black community stands up in council meetings and hurl the same slurs at council, Smitherman contends that his fellow members are not showing these malcontents proper respect. Does anyone else see a contradiction here?

To many of us who thought Smitherman's campaign offered a refreshing, thoughtful approach to a beleaguered city government and a racially divided community, he has become a huge disappointment and an embarrassment to the Charterite Committee. In practice, it is clear that Smitherman only knew how to speak the word "reconciliation."

Smitherman Still a Zealot with No Solutions

Cincinnati City Council Member and Local NAACP President Chris Smitherman is proving yet again that he has no solutions for difficult issues, he just wants to pretend he is doing something to fool people into thinking he is an effective member of council, when in fact he is a detriment to the City and all of its residents. This is more than evident from his email exchange with Council Member Cecil Thomas reported on the Enquirer's Politics Extra Blog. Here's the "shorter" version of the exchange:

Smitherman: Mr. Thomas, I have no plan, but you should hold a meeting so I can grandstand and pretend I am doing something about 'black-on-black' violence.

Thomas: Mr. Smitherman, I believe we have a program in place to help address that issue and I'm trying to get more funding for it. We can discuss this in the committee meeting on May 1st, just a few weeks away.

Smitherman: No, I want my meeting NOW, or I am going to have a hissy-fit! I will hold my breath until you give me my meeting or just force my own meeting. I still don't have a plan, I just need to pretend I am doing something.

Typical Smitherman. He still has no solution to address the violence plaguing the African-American community. He just wants a bigger soapbox to yell from so he can blame someone else for not finding a solution he can't find, himself. There is no easy or simple solution for this problem and there definitively is not a solution that will make anyone happy and win anyone re-election to any office.  The best solution would be for Smitherman to quit council or just stop pretending he's actually doing his job as a council member.

Is Smitherman a Political Whore?

Who won't Chris Smitherman, local NAACP chapter president , suck up to? He's reportedly going to have a big public meet and great with the local Tea Party. Who is next on his list? Chris Monzel? Phil Burress? Westwood Concern? I'll keep my eyes peeled for a Smitherman press release that calls for the repeal/amendment of the 14th Amendment in support of a "Birther" issue. Smitherman's been in bed with COAST for a while, and his screed against Cincinnati Public Schools seems to be a left flank attack that does nothing but hurts students and provides Chris Finney a way to demagogue public schools without lifting a finger.

It wouldn't be, I don't know, normal of Smitherman to be working with people like the Mayor of Cincinnati or...I don't know...the President of the United States instead? These men are, oh, I don't know, elected officals who happen to be....black? This fact seems to be lost on Smitherman. Has the NAACP become colorblind or has Smitherman become blind of everything but his own ambition?

Is Smitherman Under Investigation?

A complaint has been filed by a Cincinnati resident charging that Cincinnati City Council Member Christopher Smitherman is in violation of Ohio ethics rules.  Smiherman is simultaneously holding the positions of city council member and President of the Cincinnati Chapter of the NAACP, a 501(c)(4) organization.

There is clearly a conflict of interest.  Smitherman should either resign from council or more likely resign as President of the local NAACP chapter.

I seem to recall Smitherman recently wanted the city to pay for Ethics classes.  Well, Council Member Smitherman appears to not have taken his class yet.  Any person with any sense of ethics would see the conflict of being on council and being President of the local NAACP.  That leas me to believe that Smitherman lacks ethics. The reasonability test has bee exceeded ten-fold, so this compliant has merit.  The city should be investigating Smitherman to make sure he is not in violation of Ohio ethics rules.

What Exactly Is Smitherman Protesting? Seriously!

If Chris Smitherman and his followers from the local NAACP are protesting the issue of minority contracts on CPS construction projects, then I can understand the point. I don't like the fact that Smitherman has debased the local NAACP chapter into being little more than a lobbyist for black owned companies, but putting that aside, inclusion in public contracts is a fair issue to be concerned about.

The article from the Enquirer states that the protests are about working on MLK day. Seriously? This is what the protest is about? Working on a holiday? That is not a civil right and Smitherman knows that. Private companies, which are doing the construction, can be open for work any day they wish. I did know it was a priority of the NAACP, to require private companies or even vital public services to refrain from working on this particular holiday. Why would Chris Smitherman make MLK into a political football? Today is a day we should remember the man and his message and honor him. Today is a day that many people fought for and wanted, not as a political day, but a day where everyone (all races!) can honor what Dr. King did and the dream he died for.

I'm surely going to get flack from some for daring to criticize the leader of the local NAACP on today of all days, but I believe that is, in part, what Dr. King wanted: everyone to be judged by their actions, not given leave to exlpoit ideas and a movement for their own embellishment. I'm judging Smitherman by his actions and his actions are not of a man looking to help people, they are the actions of a man looking to help himself and a few of his allies. That does not do justice to anyone's memory, no matter how superficially similar it may appear. MLK was about than just knee-jerk protests. He had principles. Smitherman could use a refresher on those principles.

Smitherman Is a Loon

First off, I hate Nazis. I also hate the KKK. I don't however believe that we, as a society, should think like they think and willfully allow a situation to occur where human beings are attacked, no matter how horrible individuals may be. Chris Smitherman, recently elected president of the Cincinnati Chapter of the NAACP, issued one of the stupidest letters (pdf) from a supposed community leader that I have ever read.

Chris Smitherman has demanded the Cincinnati Police Department offer no protection for the Nazi's march. Smitherman is clearly opening the door for a situation where human beings could be beaten or even killed on the streets of Cincinnati.

If Smitherman is going to run a chapter of an organization that has long been associated with non-violence, then I fear that here in Cincinnati we have the beginning of a sectarian struggle much like the one people in Baghdad are facing today.

If you can't rise above the level of your oppressors, then you are an oppressor.

The letter is signed by him alone, so I presume this was a solo effort on his part. Smitherman is off his rocker. How did anyone ever endorse this man for office?

Additinally, I find it odd that he managed to write a letter that mentioned Christians and Muslims, but when the topic of the letter is about a Nazi group Jewish people were not mentioned at all.

Finally, Damn Chris Smitherman for making me write this post. Why does he have to create a firestorm out of this. He could have issued a simple press release condemning the idiots and requested a few things. Instead he makes demands. He makes demands in a tone that sounds like as a terrorist, nearly as much as these Nazis.

Question for Smitherman

Under the First Amendment can a student shout racial slurs at a public school teacher, and face no suspension from class? Council has passed a rule booting anyone who disrupt council meetings for 60 days. From the article:

Charterite Christopher Smitherman voted against the measure, saying the rule violates the free speech rights of people who petition City Council.

Bronson writes and quotes Smitherman in his column today, painting Smitherman's apologist views fairly plainly:

But City Council came through. Everyone voted yes except Chris Smitherman. He seems to think cops who are even accused of using the N-word five years ago should be fired - with a real torch - but people who shout and scream it at council meetings just don't get enough respect.

"We can't arbitrarily say what is disruptive and what's not," he argued, drawing disruptive applause (an almost certain indication that you're on the wrong side of an issue at City Hall). "What policies do we put forward that bring this kind of thing on?" he asked. "We must hear the voice of the people."

Smitherman I guess thinks that '400 years of oppression' makes it OK for a bunch of black racists to shout the "N-word" or the "K-word" at council members.

Bronson is actually right on this point. Smitherman is gutless. He fears taking on the black racists in town. He wants to bring the city together, but he doesn't want to stamp out all the racism. White racism is bad, but black racism must be the fault of white people. It would not surprise me to find out that Damon Lynch would have taken a better stand against black racists if he was on council.

Lack of Ethics Starts With Smitherman

Why couldn't COAST pay for an ethics lesson for Chris Smitherman himself? That would do hopefully do the most good, as long as COAST is not conducting the ethics lesson, since they don't have any. This would be a great alternative to Smitherman's motion he submitted to council requiring training sessions for council members and their staff, something the City already does. Smitherman needs a lesson in ethics. Some of things he should learn:

• Don't threaten to have your non-city-employee lawyer sue the city because council didn't vote your way.
• Don't even consider frivolous lawsuits that are more about getting legal work for your anti-city lawyer than a valid legal issue.
• Don't go on the Radio and falsely claim a member city council works for the CIA.
• Don't claim that a reason to vote for a position on the waterworks ballot issue would be to prevent the government from lacing the water of black residents with drugs.
• Don't make up numbers about how much the Streetcar plan will cost.
• Don't lie to the public when you claim Streetcar funds could be used to avoid police or fire layoffs.

Those are just the start of the many thinks Smitherman could learn. They are mostly just common sense, but a bright examples of what not to do. I really hope Smitherman can learn from these examples.

Barry Horstman's Anti-Streetcar Cheerleading Continues

In case you still had any doubt of the bias of the reporting on the Streetcar issue from the Enquirer's Barry Horstman, then read this article, which is more cheerleading than reporting. Horstman has not properly reported on what the ballot initiative says and provides a tacit explanation of it's  language with selective quotes that provide more of an argument for Smitherman to use, than a balanced summary. Any objective analysis of it, like Judge Mark Painter provided in the Enquirer, would conclude that this ballot initiative would ban the city from spending any money on any rail project, not just the streetcar. This type of bias is what I have come to expect from Horstman, which is very disappointing, but there is hope that he will soon end his involvement in reporting on this issue.  It is very pathetic that the impetus for a story on the Streetcar is going to be an email or phone call from Smitherman to Hortsman providing an update on his signature boondoggle.  The number of press releases and blog pots put out there last week on the ballot language was not something Horstman would have missed, especially if he reads the guest columnists in the newspaper that pays his salary. Hortsman failed to report on many substantive details of this situation. Here is an outline of some of what he failed to do.

1. Question Smitherman on the language used in the ballot initiative. 
2. Question COAST on the language used in the ballot initiative. (Didn't they write it?)
3. Provide evidence on the validity of the claim that August 10th is a soft deadline. This contradicts a prior article he wrote.  What changed?
4. Ask Smitherman how he's going to get over 1,200 signatures in 3 days, when it took around 5 days to get nearly 800.
5. Ask Smitherman how he knows the signatures he has gotten in the last 5 days are valid, is that his guess or have they been validated by the Board of Elections?
6. Ask Smitherman a question about a member of his campaign trashing at least one box full of CityBeat issues last Friday night. (This may happen yet. Hortsman and the Enquirer do like reporting on dirty tricks.)

That's not everything he could have done and included in the article, but the list summarizes some of the key details that would provide the most factual and fair presentation of the current situation.  We really are suffering with the lack of news gathering in this town.  TV and Radio don't have the resources to provide in depth reporting, so we are stuck with what every the Enquirer puts out.  That's a shameful way to live in a democracy.

Kabaka Oba Indicted

Ok, Black activist Oba has been indicted. Why do read this?

Police arrested Oba, a bus driver for Queen City Metro, on Oct. 7 as he completed his route. Police said he didn't ask for a lawyer - but did ask for them to call Smitherman.

"That's what he said - have them call Smitherman. And he rattled off a phone number," said Lt. Jack Kraft.

Smitherman, who did not return several phone calls seeking comment, showed up last week at Oba's first court appearance - where Smitherman confronted Municipal Court Judge Kendal Coes in the hallway.

Coes said Smitherman walked up to him and said he was there to support Oba, but did not explicitly ask the judge for any favors.

Allen vs. Smitherman

Well, I wonder who organized the speakers at city council yesterday calling out Mike Allen:

"He had no right to call this man a young punk, whether he agrees with him or not," West End resident Earmon Powell said Thursday. "He had no right to say that about our beloved brother."

For the record, Mike Allen had every right to call Chris Smitherman anything he wants. Earmon Powell is just wrong, but he has the right to make his incorrect statement if he wants.

Allen's comments were not becoming of an elected official. If the local Dems have any balls left, they will run a commercial with the"smart-mouthed little punk" comment all through Allen's future campaigns.

One contention I found laughable though:

In the past, some segments of the African-American community have complained that the chief, assistant chiefs and many members of the department's command staff are graduates of Elder High School, a predominantly white, conservative Catholic school on the West Side, and that might have influenced the way they deal with minorities.

Smitherman, though, never made that assertion, and has said he wanted the data for informational purposes.

Why didn't Smitherman provide detail on what his "informational purposes" in knowing what high school each police officer attended. There is no other logical reason to know what high school each officer went to except for proving or disproving the Elder High School story. If he wants to know the level of education of each officer or the rates of those with college degrees, that might be useful. I wonder if Smitherman asked for the names of the colleges any police officers attended.

UPDATE: Greg Mann comments and points to and Enquirer editorial. I agree with Greg that the Enquirer failed to criticize Allen for his end of the feud. I agree with much of Enquirer's critique of Smitherman's demeanor, but Allen was just as childish, if not worse. He has not gotten the "dissing" he deserves from the big media outlets. Allen is considered a "hero" in WLW land.
